The SSA denial notice will include:

• The deadline to file your appeal (typically 60 days from the date you receive the letter)

Step 2: File a Reconsideration Request

This is the first level of appeal. You must submit a Request for Reconsideration within 60 days.

• A new SSA reviewer will evaluate your claim
• You can submit new evidence, such as updated medical records or doctor’s statements
• Reconsideration can take several months

This step is still handled at the state’s Disability Determination Services level, not yet before a judge.

Step 3: Request a Hearing with an Administrative Law Judge (ALJ)

If reconsideration is denied, your next option is a hearing before an ALJ. Here's what to expect:

• You must request the hearing within 60 days of the reconsideration denial
• The judge will review your full case file and may ask you questions
• You (or your representative) can present new evidence and call witnesses, such as medical or vocational experts

Hearings may be in person, by video, or by phone — usually held at a Social Security hearing office in Iowa.

Step 4: Appeals Council and Federal Court

If the ALJ also denies your claim:

• You can request a review by the Appeals Council
• If that is unsuccessful, you can file a lawsuit in federal district court

These levels are more complex and often require experienced legal assistance.
